2020 INDIE ORIGINALS COMPETITION Rules
Indie Originals Inc. is a 501(C)(3) non-profit corporation established in the state of Florida in Brevard County. Indie Originals Inc. is solely responsible for all actions and results of this competition.
All contestants in all categories must complete the online entry form accompanied by the applicable submission fee per entry. Only entries that meet this requirement will be considered for the Indie Originals Competition. A physical mailing address must be included on your entry form. Entries submitted without a valid physical mailing address will be deemed ineligible with no refund of entry fees.
Contestants must be at least 18 years of age by September 1, 2019 at 12:01AM EST. If the contestants are part of group consisting of 2 or more members in any category, the age requirement pertains to the person who signs the entry form.
Entry fees are non-refundable. Once an entry payment has been received, we cannot provide a refund. If a payment is disputed by an entrant for any reason, the entrant will be responsible for the full entry fee amount plus any transaction fees, collection fees, or similar amounts incurred by Indie Originals in connection with the dispute. Since we are a not-for-profit enterprise, the Indie Originals Competition does not and cannot waive any entry fees. All rules and entry fees apply to any and all applicants, so no one is favored.
Submission of an entry in any category gives Indie Originals explicit and perpetual permission to exhibited, locally telecast, and reproduce the submission either in part or whole for marketing or publicity purposes. Contestants can request in writing that their material not be used for such purposes.
Please make sure you enter the applicable category(s) from the list(s) on our website. You may enter multiple categories and/or competitions, but you must submit a separate entry for each individual competition, genre, and/or category. Indie Originals retains the right to reassign any submissions to one of the listed categories without notification. Categories are listed on the Indie Originals entry forms found via
www.indieoriginals.com or www.filmfreeway.com/iol.
Music, book, film, game, or comic submissions must be “indie” releases (self-released or an independent company release). Major label music or films RELEASED by Universal, Sony Entertainment, Warner, Disney, or any major label or publisher, or their sub-labels, is NOT eligible for this competition. Although your entry may not be RELEASED by a major company, your entry may be DISTRIBUTED by a major company.
To be eligible for competition awards, all entries must be received no later than each individual competition deadline or by June 15, 2020, by 11:59 PM, whichever is earlier.
NOTIFICATION DATE: AUGUST 15, 2020 by 11:59PM
PUBLIC ANNOUNCEMENT DATE: No later than the first or second week of October 2020. But you can share your news and award as soon as you're notified.
SELECT WINNERS AND THE JUDICIAL PROCESS
Indie Originals has no obligation to disclose identities of screeners, judges, notes, feedback, or information relating to submitted work, and/or details regarding the submission review or selection process. Indie Originals explicitly disclaims any liability or responsibility for any comments, notes, or opinions expressed about a submission, whether by Indie Originals or by its volunteers.
Nominees will be notified via e-mail no later than August 15, 2020, depending on the category entered. Please ensure we have your correct e-mail address, and that email@example.com and firstname.lastname@example.org are in your approved e-mail contacts. Winners will be publicly announced at our live or digitally streamed event and posted on the Indie Originals website and remain there for at least one (1) full year, unless requested by the winner not to be listed. All selection committees’, juries’, and/or judges’ decisions are final.
Prize packages are determined by category sponsors, and could change due to market conditions, sponsor business viability, sponsor additions, or sponsor declinations. Cash values are estimated based on the average national market values of competitive offerings as of August 2019 and may fluctuate. In the event of changes, Indie Originals Inc., a charitable non-profit 501(C)(3) organization, will not be responsible for providing cash substitutes or replacement prizes.
CERTIFICATION, RETURNS & ACKNOWLEDGMENTS
Books, games, cartridges, consoles, cards, CDs, DVDs, flash drives, hard drives, or press materials will not be returned to any entrant under any circumstances. Include a self-addressed, stamped postcard for each submission if you wish acknowledgment of the receipt of your entry.
By submitting to the Indie Originals Competition, submitter agrees to indemnify Indie Originals Inc. and hold Indie Originals Inc. and its employees, owners, affiliates, and partners harmless from all claims and liability associated with your participation or entry in the Indie Originals Competition.
Submitter(s) also acknowledges that he or she has read, understood, agreed with, and will comply with all of the Terms and Conditions listed on this page, and submitter(s) accept all of the terms and conditions herein, in their entirety, without modification, and that he or she is 18 years of age or older and mentally competent to submit this application. I/We have read all of the rules, fully understand and will comply with these rules, and have complied with these rules.
I/We warrant the submission of my/our original work and that there are no disputes regarding the ownership of the submission. I/We also warrant the submitted material does not defame or invade the rights of any person living or dead. I/We understand that failure to adhere to competition rules and regulations will result in disqualification and forfeiture of entry fee. I/We acknowledge that once an entry payment has been submitted, Indie Originals will not provide a refund.
No revisions of materials will be accepted once entry has been submitted.
Indie Originals reserves the right to modify or amend the rules, terms, and conditions of this Competition without notice. Indie Originals reserves the right to cancel this competition without notification or refund in the event of a catastrophe, war, civil or military disturbance, financial failure, act of God, or any actual or anticipated breach of any applicable law or regulation or any other event outside of Indie Originals Inc. control. Any changes to the Competition status or rules will be notified to the entrants as soon as possible by Indie Originals via social media or email.
LIMITATION OF LIABILITY
All contestants, entrants, and/or participants and their agents, associates, and heirs hereby release Indie Originals Inc (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of patent, infringement of trademark, infringement of copyright, right of publicity, or any other claim related to any submitted book, game, song, video, narrative, or documentary. This release includes without prejudice or limitation any claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication any creative work entered into the Indie Originals competition.
BY SUBMITTING THE MATERIAL, I/WE HEREBY AGREES TO INDEMNIFY, HOLD HARMLESS, AND DEFEND INDIE ORIGINALS INC, ITS EMPLOYEES, DIRECTORS, REPRESENTATIVES, AND AFFILIATES FROM ALL LIABILITY, CLAIMS, AND DAMAGES IN CONNECTION WITH ANY SUBMISSION AND FROM ANY FEES AND EXPENSES, INCLUDING BUT NOT LIMITED TO ANY AND ALL ATTORNEYS’ FEES THAT MAY INCUR IN CONNECTION WITH ANY CONTROVERSY OR CLAIM ARISING FROM OR RELATING TO THIS AGREEMENT OR A BREACH THEREOF. ANY DISAGREEMENTS THAT CANNOT BE REMEDIED VIA A CIVIL AGREEMENT BETWEEN THE SUBMITTER AND INDIE ORIGINALS, INC. SHALL BE SETTLED BY ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS COMMERCIAL [OR OTHER] ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. FOR INTERNATIONAL ENTRIES, ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS CONTRACT, OR THE BREACH THEREOF, SHALL BE DETERMINED BY ARBITRATION ADMINISTERED BY THE INTERNATIONAL CENTRE FOR DISPUTE RESOLUTION IN ACCORDANCE WITH ITS INTERNATIONAL ARBITRATION RULES. THE SUBMITTER ACKNOWLEDGES AND AGREES THAT REMEDIATION WILL BE LIMITED TO A REFUND OF SUBMISSION FEES.
THIS COMPETITION IS VOID WHERE PROHIBITED.
